Enhancement of Constant Attendance Allowance of Disabled Armed Force Personnel
In terms of Para 8 of GoI, MoD letter No. 16(6)/2008(2)/2008/D(pension/Policy) dated 05 May 2009 and Para 3 of their letter even No dated 04 May 2009 “Constant Attendance Allowance shall continue to be admissible under the conditions as hither-to-fore. However, it shall be admissible at a uniform rate of Rs 3000/-PM irrespective of the rank. Further, this rate be increased by 25% every time the dearness allowance payable on revised pay band goes up by 50%”. As per GoI, Ministry of Finance, New Delhi letter No. 1/1/2014-EII(B) dated 27 Mar 2014 the rates of Dearness Allowance has been revised @ of 100% The rate of Constant Attendance Allowance will be again increased by 25% wef 01 Jan 2014 and accordingly the CAA will be payable @ Rs 4500/-PM wef 01 Jan 2014. Waiving of Excess Amount of Non-Practicing Allowance (NPA) paid to Pre 1996 Retired Armed Forces Doctors
The pension Disbursing Authorities may ensure that recovery of excess amount of element of NPA paid to pre-96 retired Armed Forces Doctors for the period from 11.09.2001 to 31.3.2008 may not be made as the same has been waived by the Govt vide letter F.No. 7(4)/2008/D(Pension/Legal) dated 18.12.2013. However, amount of excess amount of the element of NPA recovered so far is not to be refunded. PCDA (Pensions), Allahabad circular No. 18 dated 14.02.2014 refers.
“Monthly Recovery Statement” of Over-payment/Wrong Debit of Pension
It is observed that PDAs are not adhering to the instruction on submission of Recovery Statement as provided in DPPI 2013. Though PDAs are effecting recoveries through pension payment Account/Bank Scrolls but not citing the PCDA(Pen) Allahabad references against these recoveries. PCDA(Pen) Allahabad has given instructions to all Director of Treasuries, District Treasury Officer, DPDO, The Manager CPPC of Public Sector Bank and other concerned authorities are to prepare a separate ‘Monthly Recovery Statement in respect of over payment/wrong debit and forward the same to their office by 10th of the following month. The recovery statement may be signed under the PDA’s official seal. Payment of Dearness relief on Disability Element Pension during Re-employment Period
The issue has been re-examined and clarified by the Ministry vide letter dated 28.06.2013 & 03.10.2013 that disability element of disability pension is also a type of pension and provision of Govt of India DOP&PW OM No. 45/73/97-P&PW(G) dt 2.7.99 applies regarding payment of dearness relief. As such service/disability pension (including disability element) during employment is not admissible in respect of pensioners who held Group ‘A’ posts or rank of commissioned officers, at the time of their retirement. As regards payment of dearness relief on disability element of disability pension to pensioners who held post below Group A or posts below the ranks of commissioned officers, will be admissible only if their pay on reemployment is to be fixed at the minimum of the scale of the post in which they are re-employed. The exservicemen who retired before attaining the age of 55 and reemployed thereafter and their pay fixed at a higher stage because of advance increments and no protection of the last pay drawn is being given, the pay should be treated as fixed a minimum only for the purpose of ignoring the entire pension and allowing dearness relief on pension.
