Payment of Enhance Rate of OFP
Various pensioners association has represented that the orders of enhanced rate of Ordinary Family Pension are required modification (for grant of enhance the rate of family pension up to 67 years instead of 65 years in non-extension cases also).
on the issue as GoI, MoD letter No. 6(1)/99/D(Pen/Sers) dated 18.03.1999 does not debar the benefit enhanced rate of ordinary family pension for those cases where the extended term of engagement have not been granted by Screening Committee or was not availed for any other reason.
Now, it is clarified that that Armed forces personnel, who have not given extension are also eligible for an enhanced rate of ordinary family pension for 7 years or up to 67 years whichever is earlier.
PDAs are hereby authorized to make the payment of arrear in the affected case of post 30.05.1998 retirees/death where the enhanced rate of ordinary family pension was paid only up to the age of 65 years instead of 67 years age of pensioner due to non-extension of same or otherwise.
PDAs will review all past cases of post 30.05.1998 retirees/death where enhanced rate of ordinary family pension was paid less than 7 years and stopped due to completion of 65 years age of pensioner.
In such cases, if arrear due of enhanced rate of ordinary family pension due to completion of 67 years age of pensioner or 7 years whichever was earlier, the same may be calculated and paid to the affected family pensioner. In case LTA are due, if the family pensioner had died earlier before receiving it, the same may be paid as usual manner.
Revision of pension of Pre-01.01.2006 retiree Havildar granted Hony Rank of Nb Subedar
The Govt. has authorised PDAs to make the payment of pension/arrear in the affected cases of Pre-01.01.2006 Havildars granted Hony rank of Naib Subedars without any further authorisation.
All PDAs will review all the affected cases of Pre-2006 Havildars granted Hony rank of Naib Subedar and revise their pension w.e.f. 01.01.2006, 01.07.2009 and 24.09.2012 as per rates of this order. The due drawn statement may be prepared and pay the arrear due in this regard to all the affected pensioner under intimation to soft data to Officer-In-Charge Audit Section of PCDA(Pen) Allahabad.
Expeditious Disposal of Court Cases:
The Hon’ble Chief Justice of India has advised Chief Justice of all High Courts in the country to accord priority to cases involving older persons and ensures their expeditious disposal. It would extend to all the matters including civil or criminal pending in any court of law. Union Minister for Law and Justice wrote to the Chief Ministers of all States to set up Fast Track Courts (FTCs) for speedy disposal of cases. In order of disposal due priority is given to more vulnerable segments like elderly.
A separate track of courts for senior citizens would be immensely useful to dispose of all cases, civil, criminal, and pending at district level. In case additional courts can’t be created for this purpose, then administrative arrangements like in case of two FTCs, one may be earmarked to deal exclusively with cases involving senior citizens;
in case of one FTC, instructions may be issued for to deal with all cases involving elderly on priority; all cases pertaining to elderly may be transferred to the nearest FTC; all civil matters involving elderly may also be transferred to the FTC earmarked for senior citizens.
